Terms and Conditions

A. Academic Regulations

All academic and accredited programmes are subject to academic rules, regulations and applicable domestic legislation as published, revised and amended from time-to-time.

Regenesys is obligated to make personal academic information available to regulatory and administrative bodies for academic and statistical purposes.

B. Definitions

‘Academic programme’shall mean CHE accredited courses conducted by Regenesys.

‘Acceptance’ shall mean that the student has provided supporting documentation, where necessary, and has paid the application fee for the programme in advance.

‘CHE’ shall mean the Council on Higher Education;

‘In-house’ shall mean a standard or customised Regenesys programme, either short or academic, that is conducted as a package for a corporate or organisational client.

‘LMS’ shall mean the Learner Management System;

‘Management development course’ shall mean management programmes conducted over a period of 1-5 days by Regenesys on its premises or at a client’s premise.

‘Regenesys’ refers to Regenesys Education (Pty) Ltd, Registration number 1997/009003/07.

‘Roll-over/Returning Students’shall mean a student moving from one year of tuition to a following year of tuition for the same qualification.

‘Short course’ shall mean management development programme conducted by Regenesys. These programmes may vary in length and are counted in days.

C. Course Applications

All applications submitted by an student/individual, whether for a short or academic programme, require a fully completed and signed application form and acknowledgment of these terms and conditions.

All supporting documentation as laid out in the application form must be provided. Failure to provide all supporting documentation as required in terms of the application form may result in the application being rejected.

The submission of the application does not constitute the full registration for a programme. An application will be registered once the full payment and supporting documentation (where necessary) have been received.

D. Application Fee*

A non-refundable application fee of R1 240.00 (one thousand two hundred and forty Rand) is payable in order for an application to be processed. Regenesys reserves the right and absolute discretion to amend this fee from time-to-time without notice to the student/individual. In the event that the aforesaid application fee is amended, same will be included in the updated terms and conditions.

E. Regenesys Management Admissions Test (RMAT)

Master of Business Administration (MBA), International, and Recognition of Prior Learning (RPL) students are required to take our RMAT test for an additional fee of R280.00 (two hundred and eight Rand). RPL students are also required to pay an additional R845.00 (eight hundred and forty five Rand) for the RPL process. Terms and conditions apply.

F. Administration Fee*

For every qualification enrolled, the student will be required to register for each calendar year and select relevant modules to be taken during that calendar year. This facilitates better planning for tuition demands and services required. An annual administration fee (roll-over fee) of R560.00 (five hundred and sixty Rand) will be charged. This charge is for the costs associated with the administration of the student into the new calendar year.

G. Payment of Study Fees

Regenesys offers the following payment options to students for the academic programmes:

i. monthly (by compulsory debit order)

ii. per semester

iii. upfront for the full programme fees

iv. annual

Regenesys has also partnered with certain third party student loan funding institutions. In the event that the student wishes to apply for student funding, the student is encouraged to engage Regenesys for a list of their approved student funders, and the student can then engage the approved student funding institution.

The agreement will be between the student and the student funding institution, and as such, Regenesys will not be a party thereto and the student will be bound by the relevant student funding institution’s terms and conditions, which will be separate from these terms and conditions.

In the event that a student elects to pay on a monthly basis, the following will apply:

a. the first month’s payment must be paid prior to closure of registration;

b. a signed debit order needs to be completed;

c. should a payment be returned by the bank, the student will be required to reimburse Regenesys within 5 (five) days of being informed thereof. Failure to do so will render the student’s studies suspended;

d. should a monthly debit order be returned by the bank on a second occasion, in addition to reimbursing Regenesys within 5 (five) days as per (c) directly above, the student’s monthly payment arrangements will be forfeited immediately, and the student will then have to pay in advance for each module attended; and

e. a returned debit order administration fee will be charged.

An option for an extended monthly payment period is available, at Regenesys’ discretion and subject to written approval by Regenesys.

In the event that a student elects to pay for each semester:

a. the fee for the semester has to be paid prior to the closure of registration for the programme,failing which, the student will not be enrolled, will not have access to LMS and will not be permitted to attend the programme

If a student elects to pay upfront, the full programme fees need to be paid prior to the closure of registration to the specific programme. In the event that the full programme fees are not received by Regenesys prior to the closure of registration to the specific programme, the student will not be enrolled, will not have access to LMS and will not be permitted to attend the programme..

The student is informed, and accepts, that access to LMS shall be blocked in the event that the student’s fees have not be paid. Access to the student LMS will be reinstated upon receipt of the outstanding fees by Regenesys.

Should any money due by the student or the signatory/ies under his/her contract with Regenesys not be paid by the due date, then (and until such time as all monies due and payable have been received by Regenesys in full) Regenesys reserves the right to exclude the student from:

i. Attending further lectures; and/or

ii. Submitting assessments (both formative and summative); and/or

iii. Accessing the campus and all other facilities; and/or

iv. Receiving assessment results; and/or

v. Graduation.

The above is without prejudice to any other rights that Regenesys may possess in law. Exclusion as set above will not relieve the signatory/ies of any obligation to pay the contract amount or any balance being informed thereof.

For the sake of clarity, the student and/or signatories hereby agree and accept that in the event that the student is excluded from attending campus, submitting assessments, accessing the campus; receiving assessment results and/or graduating as a result of the outstanding fees, the mere fact of their exclusion will not render the debt due by the student to Regenesys void, and/or settled – the debt will still remain due, owing and payable.

The signatory/ies will remain liable for all expenses incurred by Regenesys as a result of any breach of his/her/their part of this contract and acknowledge/s that this may include legal tracing and collection costs.

In the event that it is necessary for Regenesys to institute legal action against the student for any outstanding fees, the student agrees and consents to being liable to Regenesys for the legal costs associated therewith, on the scale as between attorney and client, including, but not limited to, interest, collection commission, sheriff’s charges and disbursements.

In order for a student to graduate, their fees need to be settled in full prior to graduation. By signing and/or accepting these terms and conditions, the student knows and understands that no student will be invited to the graduation event until such a time as their account is settled in full and confirmation has been received from Regenesys to this effect.

H. Revised Fees to Applicable Year’s Rate

The programme fees will be charged at the applicable current-year’s rate, subject to change from time to time. For delayed, deferred, and repeat modules, the student will be liable for the difference between the amount originally paid for the programme, and any increase in the programme fees which may have occurred when the student elects to proceed with the programme, in order to cover the shortfall between originally paid fees and the applicable rate when the student actually does the module.

I. Cancellation and Postponement

Regenesys reserves the right to postpone and/or cancel the offering of a scheduled qualification, due to, without limitation, insufficient enrolment numbers or any reason deemed fair by Regenesys. Registered students might be provided with an alternative programme date.

All fees paid by the student, including but not limited to the amount remitted towards admission or any programme-related components, shall be deemed irrevocable non-cancellable, non-refundable, non-transferable, and unconditionally binding upon payment. No request for cancellation, refund, deferment, or transfer shall be entertained under any circumstances (except as dealt with below in terms of life-threatening illness, terminal medical condition, or permanent incapacitation directly affecting the student and rendering continued participation impossible), irrespective of whether the programme has commenced, is ongoing, or yet to commence.

Students are deemed to have accepted full and unconditional financial liability for all the programme fees upon registration. The entire programme fee shall become immediately due and payable, irrespective of attendance, access to programme content, academic performance, or withdrawal from the programme.

No refunds, fee waivers, or deferments shall be granted, except in strictly defined and highly exceptional cases, such as a life-threatening illness, terminal medical condition, or permanent incapacitation directly affecting the student and rendering continued participation impossible. In such cases:

i. A formal written request must be submitted within five (5) calendar days from the date the condition became known to the student;

ii. The formal written request must be addressed to the Client Relations Management Administrator (CRMA);

iii. It must be supported by comprehensive, original, and verifiable medical documentation issued by a registered medical practitioner;

iv. Regenesys reserves the exclusive and absolute right to assess the request and determine, at its sole discretion, whether any concession such as a partial refund, credit, or deferment may be granted.

v. Written confirmation of cancellation will be issued by the CRMA. It is the student’s responsibility to ensure acknowledgement of receipt of the cancellation request via email.

No request shall be considered in the absence of complete, original, and valid supporting documentation. Incomplete, unverifiable, fraudulent submissions shall be automatically rejected without further correspondence.

All decisions by Regenesys in respect of cancellations, refunds, or deferments shall be final, non-negotiable, and not subject to reconsideration, dispute, or challenge through any forum.

Any exception granted shall be treated as an isolated, discretionary act and shall not constitute a precedent, entitlement, or create any legitimate expectation of similar treatment in future cases.

By signing below, the student expressly confirms that they have read, understood, and accepted the above terms in full. Ignorance, disagreement, or misinterpretation of these terms after registration shall not exempt the student from their financial obligations to Regenesys.

J. Tuition Commencement

Once an application for any Regenesys programme has been processed, and a tax invoice raised, the student will be deemed to be an enrolled student and will be required to pay the programme fees and any other associated costs (subject to meeting the National Credit Act requirements and the academic requirements). Payment terms will be agreed upon, and the student will be required to pay the balance within an agreed time frame prior to commencement.

K. IT Requirement

In order for the student to complete the programme, they must:

i. be computer literate; and

ii. have a computer or tablet with a webcam, speaker, and 3G internet connectivity for the purpose of downloads and submissions.

L. Refund of Prepaid Money

Refund of any deposits and/or advance payments are subject to Regenesys cancellation terms as set out above. Regenesys will only refund monies in the limited instances as set out above, and only to the original source/issuer and Regenesys reserves the right to refund monies in the same method in which they were received.

Regenesys reserves the right, at its sole and absolute discretion, to postpone or cancel a scheduled programme. Registered students will be provided with an alternative programme date or offered a refund of programme fees.

M. Value Proposition

Programme fees include the value of digital or contact facilitation and assessments with access to digitised study guides, and one supplementary examination per module.

Additional services over and above the programme costs are charged per event, as per the current Academic Regulations.

N. Fees and Increases

Annual Increases:

Regenesys reserves the right and sole discretion to increase programme fees on an annual basis, as well as to change or amend scheduled class and exam dates without consultation with the student.

Extended Tuition Fees:

Should a student not complete the programme within the timeframe stipulated as per the program schedule, Regenesys reserves the right to adjust the outstanding module fees to those of the current retail price and to levy an extension fee, which shall be reviewed from time to time.

Discounts:

The student may apply for a potential discount if they meet the following criteria:

i. Upfront Discount: the student will save up to 10% (ten percent) by paying the annual upfront fee prior to the commencement of the programme.

ii. Alumni Discount: any students who complete a full qualification get 10% off the cost of their next program.

O. POPI Act No. 4 of 2013

The University is committed to protecting the personal information of its students and to ensuring compliance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”), and all related data protection obligations.

The student acknowledges that, in order to facilitate and expedite the processing of applications for student funding, the University may be required to disclose certain personal information of the student to a student funding institution (“Student Funder”) with whom the student has initiated or intends to initiate a funding application.

The student hereby voluntarily, expressly, and informedly consents to the University disclosing to the relevant Student Funder such personal information as is reasonably necessary for the purposes of verifying the student’s registration, identity, and related details required for the processing of the student’s funding application (“the Disclosed Information”). For the avoidance of doubt, such disclosure shall not include the student’s academic records, performance information, or any other data not strictly required for the stated purpose.

Each Student Funder acts as an independent responsible party in respect of the Disclosed Information and is required to process such information in compliance with POPIA and its own lawful data protection policies. The University shall not be liable for any processing or use of the Disclosed Information by a Student Funder beyond the purpose contemplated herein.

The University undertakes to take all reasonable technical and organisational measures to safeguard the integrity and confidentiality of the student’s personal information and to disclose only such information as is adequate, relevant, and not excessive for the purpose of facilitating the student’s funding application.

This consent shall remain valid for the duration of the student’s registration with the University and for such period thereafter as may reasonably be necessary to finalise or maintain any student funding arrangements. The student may withdraw this consent at any time by written notice to the University, provided that such withdrawal may affect the Student Funder’s ability to process or continue providing funding.

Regenesys reserves the right to share all student-related information with the sponsor/employer paying for the tuition. This includes but is not limited to marks, attendance, and assignment submission.

P. Warranty

Every student warrants that information supplied by themselves or on their behalf regarding prior qualification(s) for entry requirements is true, accurate, and legally valid. Should this be found not to be the case, the student will be legally bound to pay as per normal cancellation clauses, and any studies will be for non-degree purposes.

Regenesys also reserves the right to inform the appropriate authorities of the potential fraud, where necessary and to the extent applicable.

Q. Consent Clauses

Regenesys reserves the right to appoint an agent to collect outstanding monies on their behalf and to institute legal proceedings against the student for the recovery of any monies outstanding as a result of default in payment.

In such event the student acknowledges that they shall be liable for all legal costs incurred by Regenesys in the collection of the outstanding balance on the scale as between attorney and client, including collection of commission on capital, interest, and disbursements, as well as the tracing and administrative costs incurred by the appointed agent for the recovery of any amounts owing.

The student/undersigned hereby consents to receiving any and all documentation, notices, statements, invoices and the like via email, WhatsApp, SMS, or regular post as the communication method. The student is able to opt-out from receipt of all documentation, notices, statements, invoices and the like via email, WhatsApp, SMS, or regular post and must then advise Regenesys in writing of this opt-out.

The student/undersigned consents to Regenesys using a national credit database or third party for tracing purposes, should the student/undersigned abscond or become otherwise untraceable.

The student/undersigned consents to Regenesys being entitled to obtain credit and related information concerning the student/undersigned at any time and to exchange or lodge and/or disclose any such information (including personal information as defined in POPIA, to the extent necessary) with any credit bureau without any further notice to the student/undersigned.

R. Liability Disclaimer

Neither Regenesys nor any of its directors, subsidiaries, suppliers, employees, or agents will be held liable for accidents, illness, losses, or damage to private property of whatever nature either in South Africa or abroad, of registered Regenesys students. Students are strongly recommended to seek insurance cover for health and accident, lost luggage and/or personal belongings and trip cancellation.

Regenesys takes the integrity and professionalism of its employees seriously and strives to ensure that all staff conduct themselves in accordance with company policies and ethical standards. However, Regenesys shall not be held liable or responsible for any unauthorised actions, representations, or conduct of its employees, contractors, or agents that fall outside the scope of their official duties or that are contrary to company policy.

In particular, Regenesys shall not be liable for any loss, damage, or expense suffered by any individual and/or student as a result of providing money, gifts, or any form of payment directly to an employee, contractor, or agent without the prior written authorisation Regenesys. Any such transactions are deemed to be conducted at the individual’s/student’s own risk, and Regenesys disclaims all responsibility for any resulting financial or personal loss.

Any person who becomes aware of an employee or representative of Regenesys requesting or accepting unauthorised payments should immediately report the incident to a manager or authorised official of Regenesys, who will take appropriate disciplinary and legal action (if necessary) against any employee found to have engaged in such unauthorised conduct.

S. Firearms and Weapons

Firearms and anything that can be considered as a weapon (that can injure another person) are prohibited on the Regenesys campus. In the event that a student is found with a firearm or anything which could be considered as a weapon, Regenesys reserves the right to suspend the student pending an investigation, the outcome whereof may lead to suspension and/or expulsion from Regenesys.

T. Consent to Information

Regenesys periodically sends out information to advise all registered students and/or signed-up participants of new developments, programs, and events that might be of interest or relevance to their personal development and career advancement. The student hereby consents to Regenesys sending them information on various platforms, including, but not limited to, e-mail, SMS and/or WhatsApp. Any student or participant who wishes to stop receiving any such communication from Regenesys is requested to indicate this by opting out or by sending an email to this effect, to info@regenesys.co.za

U. Regenesys Modes of Learning

In order to make learning accessible to all registered students irrespective of their location, Regenesys is investing in e-learning resources. This involves the recording of live classes and events for livestreaming and distribution through downloadable video files on Regenesys websites. In this way, students have different options to benefit from lectures whether they are able to attend classes or not. Regenesys may also use recorded material for demonstration or promotion of its activities or depicted events to future audiences. The student hereby gives their consent to being filmed for live streaming or recording, and photographed for advertisement purposes.
